TERMS OF USE
This Terms of Use is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing terms of use for access or usage of domain name www.shiksha-reform.com (“Website” or “Site” or “Platform”)
This Platform is owned by ProShiksha Reform, a limited liability partnership registered under the Limited Liability Partnership Act, 2008 with its registered office at 603, Swastik House, Kargil Chowk, Nandi Park Society, Piplod, Surat, Gujarat 395007 (hereinafter referred to as “Shiksha Reform”).
For the purposes delineated in this document, the terms ‘you’, ‘your’ refer to any natural or legal entity who consents to become a User (as defined below) on the Website. This consent is established by completing the sign – up process, which entails One Time Password (“OTP”) verification via mobile number or email address, and subsequently registering as a User on the Website using your device. The terms ‘we’, ‘us’, ‘our’ denote Shiksha Reform.
ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS (“Terms”) UNDER THESE TERMS OF USE, HENCE, PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By implicitly or expressly accepting these Terms of Use, you also accept and agree to be bound by Shiksha Reform’s other Policies (including but not limited to Privacy Policy & Cookie Policy available at Platform) as amended from time to time.
For the purpose of this Term of Use, a “Registered User(s)” refers to an individual or entity that has completed the registration process by providing the Sign – Up Information (as defined below) on the Platform, thereby creating an Account (as defined below) with Shiksha Reform. Registered Users are granted access to enrol in Courses (as defined below) provided through the Platform, along with additional features and services exclusive to registered members. Registered Users gain the privilege to participate in Courses, track their progress, access supplementary materials, and engage in other interactive functionalities offered by the Platform. Registered Users are required to provide necessary personal information during the registration process and agree to adhere to the terms and conditions set forth by Shiksha Reform.
“Sign – Up Information” constitutes the personal data that you provide us during the registration process on the Platform. This data typically includes your full legal name, a valid email address for primary communication and verification, your date of birth to ensure compliance with age – related policies and facilitate personalized services, and your mobile number for account verification and enhanced security through One Time Password (“OTP”) verification. Shiksha Reform manages Sign – Up Information in accordance with its privacy policy, prioritizing the confidentiality and security of user data throughout its handling and storage processes.
“Courses” refer to educational programs, tutorials, lectures, or training sessions offered either directly by Shiksha Reform or by third – party providers facilitated through the platform. These courses are designed to provide users with structured learning experiences covering a variety of topics, subjects, or skills.
“Account” refers to a Registered User’s personal profile and associated credentials that grant access to various features and functionalities offered by the Platform. Unregistered Users create accounts by providing Sign – Up information and become Registered Users.
An “Unregistered User(s)” refers to any individual who accesses and utilizes the features and content available on the Platform without completing the registration process or creating an Account. Unregistered Users have limited access compared to Registered Users and may not be able to enrol in courses or access certain personalized features. Despite not having a registered account, Unregistered Users can still browse the Website, read blogs, verify Shiksha Reform Certificates (as defined below), explore information about the Platform, access the contact page, and utilize other publicly available features and functionalities.
(Hereafter Registered Users and Unregistered Users are collectively referred as “Users”)
(Hereafter, Users and Shiksha Reform are collectively referred as “Parties” and individually as “Party”)
“Shiksha Reform Certificate” is an official document issued by Shiksha Reform and verified by the Course Provider, indicating the successful completion or participation in a specific educational program or course offered through the Shiksha Reform platform. This certificate serves as recognition of the Registered User’s achievement and signifies their fulfilment of the requirements set forth by Shiksha Reform or the Course Provider (as defined below).
“Course Provider” refers to an individual, organization, institution, or entity that offers Courses through the Platform. The Course Provider may include educators, subject matter experts, educational institutions, or content creators who develop and deliver Course content for Registered Users.
- Eligibility to become a Registered User
- An Unregistered User must:
- Possess full legal capacity and authority to agree to and be bound by the Terms outlined by Shiksha Reform.
- Must be at least 18 (eighteen) years of age or older to register as a User on the platform.
- If the Unregistered User is registering on behalf of an entity, organization, or any other legal entity, they must have the requisite power and authorization to legally obligate such entity, organization, or legal person to adhere to the terms and conditions set forth by Shiksha Reform.
- By meeting these eligibility requirements, Unregistered Users can proceed with the registration process.
- Not meeting the eligibility criteria for becoming a Registered User may result in certain consequences. Users who do not meet the specified eligibility criteria may be barred from completing the registration process on the Platform.
- Ineligibility may restrict users from accessing Courses and other features, services, or content provided by Shiksha Reform that are exclusive to Registered Users.
- Attempting to register without meeting the eligibility criteria may lead to legal repercussions, as it constitutes a breach of the terms and conditions outlined by Shiksha Reform. Providing false information during the registration process or to become a Registered User may have the following consequences:
- Account suspension or termination
- Legal action
- Signing – Up for an Account
- To become a Registered User on the Platform, users must undergo the registration process by providing accurate and complete Sign – Up Information as prompted during the sign – up procedure. Users are required to provide truthful and up-to-date Sign – Up Information during the registration process.
- As part of the registration process, Users may be required to verify their identity through an OTP sent to their given mobile number or email address.
- Users must confirm that they are at least 18 (eighteen) years of age or older to register as a Registered User on the platform. Individuals below the age of 18 (eighteen) are not eligible to sign – up and create an Account.
- By completing the registration process and signing up as a Registered User on the Platform, Users acknowledge their acceptance of the Platform’s Privacy Policy, this Terms of Use and any other relevant policies or guidelines.
- Upon successful registration, Registered Users are solely responsible for maintaining the confidentiality and security of their Account credentials, including their username and password.
- Users are prohibited from creating multiple accounts, sharing their Account credentials with others, or engaging in any activity that violates this Terms of Use or Applicable Laws and Regulations.
- Shiksha Reform reserves the right to refuse or reject any registration request at its discretion, without providing any explanation or justification for such refusal. Registered Users have the responsibility to promptly update any changes to their Account information to ensure its accuracy and completeness.
- Shiksha Reform reserves the right to suspend or terminate any Registered User Account that violates the Terms of Use or engages in fraudulent or unauthorized activities on the Platform.
- By proceeding with the registration process and signing up as a user on the Shiksha Reform platform, users agree to abide by the above clauses and adhere to the platform’s policies and guidelines.
THE SIGN-UP INFORMATION PROVIDED BY USERS DURING THE REGISTRATION PROCESS IS HANDLED WITH THE UTMOST CONFIDENTIALITY AND SECURITY BY SHIKSHA REFORM. WE ARE COMMITTED TO PROTECTING THE PRIVACY AND PERSONAL DATA OF OUR USERS AND ADHERE TO STRINGENT DATA PROTECTION STANDARDS. IT IS IMPORTANT FOR USERS TO UNDERSTAND THAT THE TREATMENT OF THEIR SIGN – UP INFORMATION AND ANY OTHER DATA PROVIDED TO SHIKSHA REFORM IS GOVERNED BY OUR PRIVACY POLICY, WHICH CAN BE ACCESSED AT https://shiksha-reform.com/terms-of-use/ BY AGREEING TO THE TERMS AND PROCEEDING WITH THE REGISTRATION PROCESS, USERS ACKNOWLEDGE AND CONSENT TO THE COLLECTION, STORAGE, AND USE OF THEIR PERSONAL INFORMATION IN ACCORDANCE WITH SHIKSHA REFORM’S PRIVACY POLICY.
- Use of the Platform
- By accessing and utilizing the services provided by Shiksha Reform, you agree to adhere to the following guidelines:
- Accessing, extracting, or monitoring any content on the Platform using automated tools or methods such as ‘deep-link’, ‘page-scrape’, or ‘robot’ without explicit permission is strictly prohibited. This includes any attempt to bypass the Platform’s navigational structure or presentation.
- Unauthorized access to any section of the Platform or its associated systems through hacking or similar means is strictly prohibited.
- Users shall refrain from testing or breaching the security measures of the Platform or any connected network. Additionally, exploiting the Platform to trace or reveal personal information of other users is strictly prohibited.
- Making negative or defamatory statements about Shiksha Reform or engaging in any conduct that tarnishes its image is strictly prohibited. Users must refrain from actions that impose an unreasonable load on the Platform’s infrastructure.
- Interfering with the proper functioning of the Platform or attempting to disrupt any transaction conducted on it is not allowed.
- Impersonating another individual or entity, or misrepresenting your identity, is strictly prohibited.
- The Platform shall not be used for unlawful activities or to solicit illegal actions that infringe upon the rights of Shiksha Reform or others.
- Users must comply with all Applicable Laws, including the Information Technology Act, 2000, and any related regulations.
- By providing information to Shiksha Reform, you grant the Platform a non-exclusive right to use such information in accordance with the Terms of Use and Privacy Policy.
- Soliciting other Users for buying or selling courses or engaging in unauthorized advertising is not permitted. Users must not use information obtained from the Platform to harass, abuse, or harm others.
- Users are solely responsible for their interactions with advertisers found on the Platform, and Shiksha Reform shall not be liable for any resulting losses or damages.
- Users acknowledge the possibility of encountering offensive or obscene materials posted by other users and agree that Shiksha Reform is not responsible for such content.
- Shiksha Reform reserves the right to take necessary actions and claim damages arising from users’ involvement in DoS/DDoS attacks or similar activities.
- By accessing and using the Platform, you acknowledge and agree to adhere to these guidelines. Any violation of these terms may result in the suspension or termination of your access to the Platform. Shiksha Reform reserves the right to take legal action against violators.
- Analytics
- We analyse usage data to understand our audience better, conduct market research, and gauge advertising effectiveness. This includes tracking general market trends, surveying User needs, and assessing advertising performance. Information collected is aggregated and analysed anonymously or on an individual basis, if legally permissible, to improve user experience and provide better services.
- Our platform collects data on User page visits to improve user experience, personalize content, and analyse platform performance. This includes monitoring courses viewed, time spent on courses, and content interactions. User data is aggregated and anonymized to gain insights into user preferences and optimize content delivery. We treat this information confidentially and do not share individual page-view data unless required by law.
- We collect data on the amount of time users spend on each page to enhance user experience and analyse engagement. This data helps us improve content relevance and optimize platform functionality. User visit durations are aggregated and anonymized, and individual data is not shared with third parties unless required by law.
- In the event of a website crash, we automatically collect crash-related information for diagnostic purposes. This includes device information and circumstances leading to the crash. The collected data is used solely for internal analysis and troubleshooting to improve website stability and user experience. We do not use crash data for other purposes or share it with third parties unless required by law.
- We collect data related to in-website course purchases to enhance User experience and provide personalized recommendations. This includes details about courses viewed, added to cart, and purchased within the platform. The collected data is used in aggregated and anonymized form to optimize in-website navigation and tailor content to user interests. User tracking information is treated confidentially, and personally identifiable information is not associated with in-website course purchases unless explicitly provided by the user.
- Content posted on Platform.
- All content, including blogs, courses, text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, and artwork, is safeguarded by the intellectual property rights owned by Shiksha Reform or the Course Providers, as the case may be. Users are expressly prohibited from using the content for any commercial purposes, including but not limited to resale or redistribution. Unauthorized use of the content is strictly forbidden and may result in the termination of user accounts, as well as potential legal actions.
- The act of purchasing courses through the Shiksha Reform platform does not transfer ownership of the intellectual property rights associated with the content. The ownership and all associated rights remain firmly with Shiksha Reform.
- While Shiksha Reform strives to provide accurate and up-to-date content, users are encouraged to use their discretion and report any inaccuracies.
- Except as expressly provided in these Terms of Use, no part of the Platform and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including ‘mirroring’) to any other computer, server, Platform, or other medium for publication or distribution or for any commercial enterprise, without Shiksha Reform’s express prior written consent.
- Intellectual Property Rights
- All content hosted on the Platform, including blogs and courses, unless explicitly stated otherwise, is safeguarded by the intellectual property rights owned by Shiksha Reform. This content constitutes Shiksha Reform’s exclusive proprietary property. All elements comprising the source code, databases, functionality, software, website designs, application designs, audio, video, text, photographs, and graphics found on the Platform, as well as the trademarks, service marks, and logos contained therein (the “Marks”), are either owned or under our control, or licensed to Shiksha Reform, and are safeguarded by copyright, trademark laws, and various other intellectual property rights.
- The Content and Marks presented on the Platform are for informational and personal use only. Except as explicitly stipulated in these Terms, no part of the Platform, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written consent. Subject to eligibility, the User is granted a limited license to access and utilize the Platform, and to download or print a copy of any accessible portion of the Content exclusively for personal, non-commercial use. All rights not expressly granted in and to the Platform, the Content, and the Marks are reserved by Us.
- The entirety of the Content featured on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the rightful property of Shiksha Reform, its affiliates, or its content suppliers, and is safeguarded by both Indian and international copyright, authors’ rights, and database right laws. The compilation of all Content present on this Website stands as the exclusive property of Shiksha Reform and its affiliates, further protected by the laws of India and database right legislation. All software utilized on this Platform is the property of Shiksha Reform, its affiliates, or its software suppliers, and is protected under Indian laws. Users are expressly prohibited from systematically extracting or re-utilizing any portions of the Content of the Platform without the express written consent of Shiksha Reform and/or its affiliates, as applicable. Specifically, Users shall not employ data mining, robots, or similar tools for data gathering and extraction to retrieve substantial parts of this Platform, whether on a single occasion or repeatedly, for re-utilization, without the explicit written consent of Shiksha Reform and/or its affiliates, as applicable.
- License for Platform Access
- Access for Registered Users
- Registered Users are granted comprehensive access to the Platform, including the ability to enrol in courses, access supplementary materials, and engage in interactive functionalities.
- Upon registration, Registered Users receive a limited, non-exclusive, non-transferable, and revocable license to access and utilize the Platform’s full range of features and services. This license permits Registered Users to participate in courses, track their progress, and interact with course content according to the terms outlined by Shiksha Reform.
- Registered Users may also access personalized recommendations, receive updates on course offerings, and enjoy enhanced user experiences tailored to their individual learning preferences.
- Access for Unregistered Users
- Unregistered Users, while having access to certain features and content on the Platform, have limited privileges compared to Registered Users.
- Unregistered Users can explore the Website, read blogs, verify Shiksha Reform Certificates, access the contact page, and utilize other publicly available features. However, Unregistered Users may not enrol in courses or access certain personalized features exclusive to Registered Users.
- The license granted to Unregistered Users is restricted to accessing publicly available content and functionalities and does not include participation in courses or access to supplementary materials reserved for Registered Users.
- Access to Courses
- Registered Users are granted exclusive access to enrol in courses offered through the Platform. Upon enrolment, Registered Users gain access through their Account to course materials, lectures, assessments, and other educational resources provided by Shiksha Reform or Course Providers.
- The license to access Courses is contingent upon the User’s registration and adherence to the Terms outlined by Shiksha Reform. Unregistered Users, on the other hand, do not have the privilege to enrol in courses or access course materials beyond publicly available content. The license to access courses is expressly reserved for Registered Users who have completed the registration process and agreed to comply with the Platform’s terms of use.
- Access for Registered Users
- Disclaimer of Warranties and Liability
- This Platform, along with all materials (including software and Website) and services provided on or through this site, is presented on an “as is” and “as available” basis without any representations or warranties, express or implied, unless otherwise specified in writing. Without limiting the foregoing paragraph, Shiksha Reform does not guarantee that:
- This Platform will be continuously available or available at all times.
- The information on this Platform is complete, true, accurate, or non-misleading.
- Shiksha Reform will be liable to you in any way or in relation to the contents of, or use of, or otherwise in connection with the Platform. Shiksha Reform does not warrant that this site; information, Content, materials, product (including courses) or services included on or otherwise made available to you through the Platform; their servers; or electronic communication sent from Us are free from viruses or other harmful components.
- To the fullest extent permitted by law, the Platform, our directors, employees, or agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform.
- The Platform warrants that it will employ industry-standard security measures to safeguard User data. However, it does not guarantee absolute protection against unauthorized access or data breaches caused by unforeseeable events.
- This warranty does not cover defects or issues arising from:
- Any unauthorized modifications or alterations to the Platform by the User or any third party not expressly authorized by the LLP.
- Alterations made to the Platform’s code, configuration, or settings without explicit permission from the LLP.
- The use of the Platform in a manner inconsistent with the Terms or intended purpose as specified by the Platform.
- The integration of the Platform with any other software, applications, or services not explicitly authorized by the LLP in writing.
- Any issues arising from the use of third-party plugins, extensions, or components that have not been officially endorsed or approved by the LLP.
- Force Majeure Events including but not limited to acts of nature, war, terrorism, riots, embargoes, or other unforeseen circumstances that make the performance of this Warranty impossible or impractical.
- Any defects or issues arising from circumstances not reasonably foreseeable by the LLP or Platform at the time of entering into this Warranty.
- Indemnification
- User agrees to defend, indemnify, and hold Shiksha Reform, its subsidiaries, affiliates, and all of their respective officers, directors, employees, agents, and partners harmless from and against any and all claims, liabilities, damages, losses, demands, actions, judgments, settlements, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- User’s use of the Shiksha Reform Platform;
- Any breach of these Terms of Use or any other agreements between User and Shiksha Reform;
- User’s violation of any laws, regulations, or third-party rights;
- User’s misuse or unauthorized use of the Platform or any content therein;
- Any content or information submitted, posted, transmitted, or made available by User on or through the Platform;
- Any infringement of intellectual property rights or other proprietary rights by User;
- Any fraudulent, negligent, or wilful misconduct by User;
- Any interactions or transactions between User and any other User, Course Provider, or third party facilitated by the Platform;
- Any claim that User’s use of the Platform caused damage to a third party;
- Any failure by User to comply with applicable laws, rules, or regulations.
- Shiksha Reform reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by User. User agrees to cooperate fully with Shiksha Reform in the defence of any such claim and agrees not to settle any matter without the prior written consent of Shiksha Reform.
- Notification of Claims: User agrees to promptly notify Shiksha Reform of any claims or demands made against User by any third party that may give rise to indemnification obligations under this Clause. Failure to promptly notify Shiksha Reform shall not relieve User of its indemnification obligations, except to the extent that User can demonstrate actual prejudice as a result of such failure.
- User hereby waives, releases, and forever discharges Shiksha Reform, its subsidiaries, affiliates, and all of their respective officers, directors, employees, agents, and partners from any and all claims, liabilities, damages, losses, demands, actions, judgments, settlements, costs, and expenses arising out of or in connection with the matters covered by this Indemnification Clause.
- User acknowledges that Shiksha Reform acts solely as a platform to facilitate the provision of courses by Course Providers. Shiksha Reform does not directly provide the courses listed on its platform. Therefore, User agrees to indemnify and hold harmless Shiksha Reform from any claims, liabilities, damages, losses, demands, actions, judgments, settlements, costs, and expenses arising out of or in connection with User’s interaction with Course Providers or participation in any courses offered by Course Providers through the Shiksha Reform Platform.
- If any provision of this Indemnification Clause is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
- Third-Party Websites and Content
- The Platform may contain links to third-party websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, designs, music, sound, video, information, applications, software, and other content or items originating from third parties (“Third-Party Content”).
- Third-Party Websites and Third-Party Content available on the Platform is not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us. Shiksha Reform bears no responsibility for any Third-Party Websites accessed through the Platform or any Third-Party Content posted on, available through, or installed from the Platform, including the content, accuracy, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content.
- The Users acknowledge that accessing Third-Party Websites or using Third-Party Content carries risk, and they should be aware that these Terms of Use no longer govern such interactions.
- Users should review the applicable terms and policies, including privacy and data gathering practices, of any Third-Party Websites they navigate from the Shiksha Reform Platform or any applications they use or install from the Platform.
- Governing Law and Dispute Resolution
- Any dispute, controversy, or claim arising out of or in connection with these Terms, including disputes regarding its existence, validity, interpretation, performance, or termination (“Dispute”), shall be resolved in accordance with the laws of Surat, Gujarat, India.
- In the event of a Dispute, the Parties shall first attempt to resolve it amicably through good-faith negotiations. Both Parties shall provide written notice to the other Party outlining the nature of the Dispute and their proposed resolution. The other Party shall respond within 15 (fifteen) days. The Parties shall cooperate and make reasonable efforts to reach a mutually acceptable resolution.
- If the Dispute is not resolved through good-faith negotiations or either of the Party does not respond to the notice as required herein above, the Parties agree to submit the Dispute to binding arbitration. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof. The arbitration shall be administered by a sole arbitrator appointed by Shiksha Reform. The seat of arbitration shall be Surat, Gujarat, India and the language of arbitration shall be English.
- By using the Platform, User agrees to abide by this dispute resolution clause and waives any rights to pursue a claim in any manner inconsistent with this Term.
- Miscellaneous
- Waiver: These Terms and any policies or operating rules posted on the Platform or in respect to the Platform constitute the entire agreement and understanding between the User and the Platform. Shiksha Reform’s failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
- Assignment: These Terms operate to the fullest extent permissible by law. Shiksha Reform may assign any or all of its rights and obligations to others at any time. Shiksha Reform shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond its reasonable control.
- Severability: If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
- There is no joint venture, partnership, employment, or agency relationship created between the User and Shiksha Reform as a result of these Terms or use of the Platform. User hereby agrees that these Terms will not be construed against Shiksha Reform by virtue of having drafted them. User hereby waives any and all defences it may have based on the electronic form of these Terms and the lack of signing by the parties hereto to execute these Terms.
- Site Management
- We reserve the right, but not the obligation, to:
- Monitor the Site for violations of these Terms of Use;
- Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such User to law enforcement authorities;
- Refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof, at our sole discretion and without limitation;
- Remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;
- Otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
- Privacy Policy

- Copyright Infringements
- We respect the intellectual property rights of others. If you believe that any material available on or through the Site infringes upon any copyright you own or control, please immediately notify us using the contact information provided below (“Notification”). A copy of your Notification will be sent to the person who posted or stored the material addressed in the Notification.
- Term and Termination
- These Terms of Use shall remain in full force and effect while you use the Site. Without limiting any other provision of these Terms Of Use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the site (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms of use or of any applicable law or regulation.
